Article 1 – Identity of the operator

Article 2 – Definitions
In these General Terms and Conditions the following expressions shall have the following meanings:
1. Operator: Travelher or Monique Rhuggenaath
2. Consumer: the natural person not acting in the exercise of profession or business, and who enters into a distance contract with the operator;
3. Means of distance communication: a medium which can be used to enter into an agreement, without physical proximity of the consumer and the operator, such as (but not limited to) by fax, telephone and internet;
4. Distance contract: an contract in which, up to the conclusion of the contract, exclusive use is made of one or more means of distance communication in the system organised by the vendor or service provider (operator) for distance sale of products and/or services;
5. Right of withdrawal: the option for consumers to withdraw from the distance contract within the cooling-off period;
6. Cooling-off period: the period during which the consumer may avail of his right of withdrawal;
7. Day: calendar day;
8. Long-term transaction: a distance contract concerning a number of products and/or services, for which the offer and/or purchasing obligation is spread over a longer period;
9. Long-term data storage media: any means that allow the consumer or operator to store all information which is directed to him/her personally, in such a way that allows for future consultation and unaltered reproduction of that information.
Article 3 – Applicability
1. These general terms and conditions apply to any distance contract entered into by the operator and the consumer, and to any offer from the operator.
2. Before concluding a distance contract, the operator makes the text of these general terms and conditions available to the consumer. If it is not possible to make the general terms and conditions available in advance, the operator shall, before concluding the distance contract, indicate that the consumer may consult the general terms and conditions and that on request, these shall be sent free of charge to the consumer as quickly as possible. The text of these general terms and conditions may also be supplied to the consumer electronically, in such a way that the consumer can easily store it on a sustainable data storage medium. If this is not possible, , before concluding the distance contract it will be specified where the general terms and conditions can be viewed electronically and that they will be delivered upon request from the consumer, either via electronic means or otherwise;
3. If, in addition to these general terms and conditions certain product or service conditions apply, the second paragraph shall apply accordingly, and in the event of contradictory (general) conditions, the consumer may always appeal to the applicable provision most favourable to him/her.
Article 4 – The contract
1. The contract becomes valid the moment the consumer accepts the offer and meets the terms and conditions, with due regard for the stipulations in paragraph 6 of this article.
2. If the consumer accepts the offer via electronic means, the operator shall immediately confirm the receipt of the acceptance of the offer via electronic means. Up to the moment the receipt of said acceptance has not been confirmed by the operator, the consumer may repudiate the contract.
3. If the consumer has accepted the offer via electronic means, the operator must take appropriate technical and organisational security measures for the electronic data transfer. The operator shall take appropriate security measures into account if the consumer is given the option to pay electronically. In this context, the operator shall ensure a secure web environment.
4. The operator shall send the following information along with the product or service, in writing or in such a way that it can be stored on a sustainable data storage medium by the consumer in an accessible manner:
a. The visiting address of the business establishment of the operator where the consumer may go with any complaints;
b. the conditions for termination of the contract if the contract has a duration of more than one year or is indefinite;
c. the information as stated in article 5, paragraph 3, unless the operator already provided the consumer with this information before the execution of the contract;
d. the information corresponding to guarantees for consumer goods and after-sales services;
e. the conditions under which, and the manner in which the consumer may avail of the right of withdrawal, or a clear notification with regards the exclusion from the right of withdrawal.
5. If the operator has undertaken to deliver a series of products or services, the stipulation in paragraph 4 applies to the first delivery only.
6. The operator may (within the limits of the law, obviously) gather information about the ability of the consumer to fulfil his commitments, as well as all facts and factors relevant to a distance contract. If the operator, acting on the results of this investigation, has sound reasons not to enter into the agreement, he is lawfully entitled to refuse an order or request, or to include special terms for its execution.
Article 5 – The offer
1. The operator shall explicitly state if an offer is of limited duration, or if certain conditions apply.
2. The offer contains a complete, accurate and detailed description of the products and/or services provided, so that the consumer is able to judge the product/service adequately. If pictures are used with the offer, they are to be real pictures of the products and/or services provided. Obvious mistakes or errors in the offer, for which it may be immediately clear to the consumer as mistakes or errors, are not binding for the operator.
3. With an offer, the operator clearly indicates what the rights and duties of the consumer are when accepting the offer. Important therein are:
ï‚· the price including taxes;
ï‚· if applicable, the delivery costs;
ï‚· the negotiation procedure of the contract and how the consumer may establish these negotiations;
ï‚· delivery, payment or execution procedure of the contract;
ï‚· the manner in which the consumer may seek information about actions he/she does not require before concluding the contract, as well as the way he may correct these actions before the conclusion of the contract;
ï‚· possible languages, including Dutch, in which the contract shall be entered into;
ï‚· the codes of conduct to which the operator has submitted and the manner in which the consumer can consult the codes of conduct via electronic means, and
ï‚· the minimum duration of the distance contract in the event of a long-term contract or a contract, including continuous or periodical delivery of products or services.
ï‚· whether or not the right of withdrawal applies;
ï‚· if the contract is filed after conclusion, how the consumer can consult it;
ï‚· the price of distance communication if the costs for using the technology for distance communication are calculated on a basis other than that of the service charge;
ï‚· acceptance period of the offer, or the period for which the price will be honoured.
Article 6 – The price
1. All prices of the offered products or services shall include VAT. Under no circumstances are hidden costs permitted, such as taxes (VAT), packaging or delivery charges. Where these costs apply, they are to be indicated clearly with the offer.
2. The prices of the products and/or services provided shall not be raised during the validity period stated in the offer, subject to changes in price due to changes in VAT rates.
3. With products or services whose prices are subject to fluctuations in the financial market that are out of the control of the operator, the operator may, contrary to the previous paragraph, offer products/services at variable prices, provided the operator clearly indicates with the offer that prices may vary and that the prices indicated are target prices.
4. Price increases within three months of the conclusion of the contract are not permitted unless they are the result of statutory schemes or provisions.
5. Price increases after three months of the conclusion of the contract are not permitted unless the operator has negotiated this, they are the result of statutory schemes or provisions, or the consumer has the option to terminate the contract in the event of a price increase.
Article 7 – Payment
1. The amounts owed by the consumer are, unless agreed otherwise, to be paid within 14 days after ordering the goods.
2. In the event of non-payment or default of payment on the part of the consumer, the operator may, unless lawful restrictions apply, charge any reasonable costs incurred to the consumer, provided that the consumer was informed of this beforehand.
3. The consumer is to inform the operator immediately of possible inaccuracies in the payment details provided or stated.
4. When selling products to consumers, it is not permitted to stipulate an advance payment of more than 50% in the general terms and conditions. It is permitted to negotiate an advance payment of more than 50%. If an advance payment was agreed, the consumer may not assert any rights regarding the execution of that order or service before the agreed advance payment has been made.
Article 8 – Right of Withdrawal with delivery of products
1. When purchasing products, the consumer has the right to repudiate the contract without specifying any reasons, for a period of 14 days, starting the day of receipt of the product, purchased by or on behalf of the consumer.
2. In the event the consumer wishes to avail of the right of withdrawal, he or she may only unpack or use the product to the extent necessary to judge whether or not he or she wishes to keep the product. During this period, the consumer shall treat the product and packaging material carefully. The consumer shall return the product with all delivered accessories and, as far as possible, in the original condition and packaging, in accordance with the reasonable and clear instructions indicated by the operator.
Article 9 – Right of Withdrawal with the provision of services
1. In the case of providing services, the consumer has the right to repudiate the contract without specifying any reasons, for a period of 14 days, starting the day of the commencement of the contract.
2. The consumer shall follow the reasonable and clear instructions to avail of his right of withdrawal, as provided to him by the operator with the offer and/or at the latest, with the delivery.
Article 10 – Costs in the event of withdrawal
1. In the event the consumer avails of his right of withdrawal, the maximum he or she shall be charged is the amount equal to that of the returning costs.
2. In the event the consumer has made a payment, the operator shall return this amount as quickly as possible, no later than 30 days after the return or withdrawal.
Article 11 – Exclusion from the right of withdrawal
1. The right of withdrawal may only be excluded by an operator if the operator has clearly indicated this in the offer and in good time before commencing the contract.
2. Exclusion of the right of withdrawal is only possible for products:
a. that spoil or age quickly;
b. that cannot be returned due to their nature;
c. for audio and video recordings and computer software of which the consumer has broken the seal;
d. for copies of newspapers and magazines;
e. that were made by the operator in accordance to the specifications of the consumer;
f. whose prices are subject to fluctuations in the financial market that are out of the control of the operator;
g. that are obviously of a personal nature;
3. Exclusion of the right of withdrawal in case of services is possible:
a. with betting and lotteries;
b. with services of which the delivery, with explicit consent of the consumer, started before the cooling-off period expired;
c. regarding transport, transportation, restaurant business, accommodation or leisure activities, to be carried out on a certain date during a certain period.
Article 12 – Long-term transactions
1. When a contract is entered into for an indefinite period, the consumer may terminate the contract at any time, with due consideration of the conditions for termination of the contract, and a period of notice of no more than one month.
2. The maximum term for a fixed-term contract is two years. If it has been agreed that the distance contract will be extended in the event of tacit consent of the consumer, the contract shall be continued as a contract of indefinite period, and the period of notice after continuation of the contract shall be no more than one month.
Article 13 – Delivery and execution
1. When receiving and when executing product orders, as well as with the assessment of requests for the provision of services, the operator shall execute these tasks with due diligence.
2. The operator acknowledges electronic communication and shall not deny its validity or legal effects for the sole reason that the communication happens electronically.
3. If delivery of an ordered product turns out to be permanently impossible, the operator shall make an effort to offer an equivalent replacement product. It shall be reported in a clear and comprehensible manner that a replacement product will be delivered at delivery at the latest. With replacement products, the right of withdrawal cannot be excluded and the consumer is free to repudiate the contract, in which case any possible costs for return shipment shall be borne by the operator.
4. Unless explicitly agreed otherwise, the risk of loss and/or damage to products shall remain with the operator until the moment of delivery to the consumer.
5. The address provided by the consumer to the operator shall be the place of delivery.
6. The operator shall, considering the stipulations in Article 5, execute accepted orders with convenient speed, within 30 days, unless a longer delivery period was agreed. In the event of delay in delivery, or if an order cannot be delivered or only partially be executed, the consumer shall be informed of this no later than one month after ordering. In such cases, the consumer is entitled to repudiate the contract free of charge and a right to possible compensation.
7. In the event of repudiation under the preceding paragraph, the operator shall return the payment made by the consumer as quickly as possible, no later than 30 days after repudiation.
Article 14 – Guarantee
A guarantee arrangement provided by the operator, manufacturer or importer cannot limit or set aside the rights and claims a consumer has by virtue of the law and/or the distance contract regarding any shortcoming of the operator in the fulfilment of the obligations toward the consumer.
Article 15 – Conformity
The operator guarantees that the products and/or services comply with the contract, the specifications listed in the offer, the reasonable requirements of usability and/or reliability, and the existing provisions of the law and/or government regulations on the date the contract was entered into.
Article 16 – Settlement of complaints
1. The operator shall have a sufficiently advertised complaints procedure and shall attend to the complaint in accordance with this complaints procedure.
2. Complaints about the execution of the contract are to be fully and clearly described and submitted to the operator within a reasonable period after the consumer has established the defects.
3. The operator shall attend to and address the submitted complaints as quickly as possible, but no later than 14 days from the date of receipt. If a complaint is expected to require a longer processing time, the operator shall answer within the 14-day period with an acknowledgement of receipt and
an indication of when the consumer may expect a more comprehensive response.
4. A complaint about a product, a service or the quality of service provided by the operator can be submitted through the contact meform on the Travelher website.
Article 17 – Additional conditions or deviations
Additional conditions or deviations from these general terms and conditions may not be to the prejudice of the consumer and must be put in writing or be recorded in such a way that they can be stored by the consumer in an accessible manner on a sustainable data storage medium.
Article 18 – Amendments to the general terms and conditions
Amendments to these terms and conditions shall not come into force until they are appropriately published. In cases of amendments made during the course of an offer, the condition(s) most favourable to the consumer shall prevail.
Article 19 – Governing law
Contracts between the operator and the consumer, to which these general terms and conditions apply, are strictly governed by Dutch law.

- Ondernemer: de natuurlijke of rechtspersoon die producten en/of diensten op afstand aan consumenten aanbiedt;
- Consument: de natuurlijke persoon die niet handelt in de uitoefening van beroep of bedrijf en een overeenkomst op afstand aangaat met de ondernemer;
- Overeenkomst op afstand: een overeenkomst waarbij in het kader van een door de ondernemer georganiseerd systeem voor verkoop op afstand van producten en/of diensten, tot en met het sluiten van de overeenkomst uitsluitend gebruik gemaakt wordt van één of meer technieken voor communicatie op afstand;
- Techniek voor communicatie op afstand: middel dat kan worden gebruikt voor het sluiten van een overeenkomst, zonder dat consument en ondernemer gelijktijdig in dezelfde ruimte zijn samengekomen;
- Bedenktijd: de termijn waarbinnen de consument gebruik kan maken van zijn herroepingsrecht;
- Herroepingsrecht: de mogelijkheid voor de consument om binnen de bedenktijd af te zien van de overeenkomst op afstand;
- Dag: kalenderdag;
- Duurtransactie: een overeenkomst op afstand met betrekking tot een reeks van producten en/of diensten, waarvan de leverings‑ en/of afnameverplichting in de tijd is gespreid;
- Duurzame gegevensdrager: elk middel dat de consument of ondernemer in staat stelt om informatie die aan hem persoonlijk is gericht, op te slaan op een manier die toekomstige raadpleging en ongewijzigde reproductie van de opgeslagen informatie mogelijk maakt.

Artikel 3 - Toepasselijkheid
- Deze algemene voorwaarden zijn van toepassing op elk aanbod van de ondernemer en op elke tot stand gekomen overeenkomst op afstand tussen ondernemer en consument.
- Voordat de overeenkomst op afstand wordt gesloten, wordt de tekst van deze algemene voorwaarden aan de consument beschikbaar gesteld. Indien dit redelijkerwijs niet mogelijk is, zal voordat de overeenkomst op afstand wordt gesloten, worden aangegeven dat de algemene voorwaarden bij de ondernemer zijn in te zien en zij op verzoek van de consument zo spoedig mogelijk kosteloos worden toegezonden.
- Indien de overeenkomst op afstand elektronisch wordt gesloten, kan in afwijking van het vorige lid en voordat de overeenkomst op afstand wordt gesloten, de tekst van deze algemene voorwaarden langs elektronische weg aan de consument ter beschikking worden gesteld op zodanige wijze dat deze door de consument op een eenvoudige manier kan worden opgeslagen op een duurzame gegevensdrager. Indien dit redelijkerwijs niet mogelijk is, zal voordat de overeenkomst op afstand wordt gesloten, worden aangegeven waar van de algemene voorwaarden langs elektronische weg kan worden kennisgenomen en dat zij op verzoek van de consument langs elektronische weg of op andere wijze kosteloos zullen worden toegezonden.
- Voor het geval dat naast deze algemene voorwaarden tevens specifieke product- of dienstenvoorwaarden van toepassing zijn, is het tweede en derde lid van overeenkomstige toepassing en kan de consument zich in geval van tegenstrijdige algemene voorwaarden steeds beroepen op de toepasselijke bepaling die voor hem het meest gunstig is.
- Indien een aanbod een beperkte geldigheidsduur heeft of onder voorwaarden geschiedt, wordt dit nadrukkelijk in het aanbod vermeld.
- Het aanbod bevat een volledige en nauwkeurige omschrijving van de aangeboden producten en/of diensten. De beschrijving is voldoende gedetailleerd om een goede beoordeling van het aanbod door de consument mogelijk te maken. Als de ondernemer gebruik maakt van afbeeldingen zijn deze een waarheidsgetrouwe weergave van de aangeboden producten en/of diensten. Kennelijke vergissingen of fouten in het aanbod binden de ondernemer niet.
- Elk aanbod bevat zodanige informatie, dat voor de consument duidelijk is wat de rechten en verplichtingen zijn, die aan de aanvaarding van het aanbod zijn verbonden. Dit betreft in het bijzonder:
- ·de prijs inclusief belastingen;
- ·de eventuele kosten van aflevering;
- ·de wijze waarop de overeenkomst tot stand zal komen en welke handelingen daarvoor nodig zijn;
- ·het al dan niet van toepassing zijn van het herroepingsrecht;
- ·de wijze van betaling, aflevering of uitvoering van de overeenkomst;
- ·de termijn voor aanvaarding van het aanbod, dan wel de termijn voor het gestand doen van de prijs;
- ·de hoogte van het tarief voor communicatie op afstand indien de kosten van het gebruik van de techniek voor communicatie op afstand worden berekend op een andere grondslag dan het basistarief;
- ·indien de overeenkomst na de totstandkoming wordt gearchiveerd, op welke wijze deze voor de consument te raadplegen is;
- ·de wijze waarop de consument voor het sluiten van de overeenkomst van door hem niet gewilde handelingen op de hoogte kan geraken, alsmede de wijze waarop hij deze kan herstellen voordat de overeenkomst tot stand komt;
- ·de eventuele talen waarin, naast het Nederlands, de overeenkomst kan worden gesloten;
- ·de gedragscodes waaraan de ondernemer zich heeft onderworpen en de wijze waarop de consument deze gedragscodes langs elektronische weg kan raadplegen; en
- ·de minimale duur van de overeenkomst op afstand in geval van een overeenkomst die strekt tot voortdurende of periodieke aflevering van producten of diensten.
- De overeenkomst komt, onder voorbehoud van het bepaalde in lid 4, tot stand op het moment van aanvaarding door de consument van het aanbod en het voldoen aan de daarbij gestelde voorwaarden.
- Indien de consument het aanbod langs elektronische weg heeft aanvaard, bevestigt de ondernemer onverwijld langs elektronische weg de ontvangst van de aanvaarding van het aanbod. Zolang de ontvangst van deze aanvaarding niet is bevestigd, kan de consument de overeenkomst ontbinden.
- Indien de overeenkomst elektronisch tot stand komt, treft de ondernemer passende technische en organisatorische maatregelen ter beveiliging van de elektronische overdracht van data en zorgt hij voor een veilige webomgeving. Indien de consument elektronisch kan betalen, zal de ondernemer daartoe passende veiligheidsmaatregelen in acht nemen.
- De ondernemer kan zich – binnen wettelijke kaders – op de hoogte stellen of de consument aan zijn betalingsverplichtingen kan voldoen, alsmede van al die feiten en factoren die van belang zijn voor een verantwoord aangaan van de overeenkomst op afstand. Indien de ondernemer op grond van dit onderzoek goede gronden heeft om de overeenkomst niet aan te gaan, is hij gerechtigd gemotiveerd een bestelling of aanvraag te weigeren of aan de uitvoering bijzondere voorwaarden te verbinden.
- De ondernemer zal bij het product of dienst aan de consument de volgende informatie, schriftelijk of op zodanige wijze dat deze door de consument op een toegankelijke manier kan worden opgeslagen op een duurzame gegevensdrager, meesturen:
b. de voorwaarden waaronder en de wijze waarop de consument van het herroepingsrecht gebruik kan maken, dan wel een duidelijke melding inzake het uitgesloten zijn van het herroepingsrecht;
c. de informatie over bestaande service na aankoop en garanties;
d. de in artikel 4 lid 3 van deze voorwaarden opgenomen gegevens, tenzij de ondernemer deze gegevens al aan de consument heeft verstrekt vóór de uitvoering der overeenkomst;
e. de vereisten voor opzegging van de overeenkomst indien de overeenkomst een duur heeft van meer dan één jaar of van onbepaalde duur is.
6. Indien de ondernemer zich heeft verplicht tot het leveren van een reeks van producten of diensten is de bepaling in het vorige lid slechts van toepassing op de eerste levering.
Artikel 6a - Herroepingsrecht bij levering van producten
1. Bij de aankoop van producten heeft de consument de mogelijkheid de overeenkomst zonder opgave van redenen te ontbinden gedurende zeven werkdagen. Deze termijn gaat in op de dag na ontvangst van het product door of namens de consument.
2. Tijdens deze termijn zal de consument zorgvuldig omgaan met het product en de verpakking. Hij zal het product slechts in die mate uitpakken of gebruiken voor zover dat nodig is om te kunnen beoordelen of hij het product wenst te behouden. Indien hij van zijn herroepingsrecht gebruik maakt, zal hij het product met alle geleverde toebehoren en – indien redelijkerwijze mogelijk - in de originele staat en verpakking aan de ondernemer retourneren, conform de door de ondernemer verstrekte redelijke en duidelijke instructies.
Artikel 6b - Herroepingsrecht bij levering van diensten
- Bij levering van diensten heeft de consument de mogelijkheid de overeenkomst zonder opgave van redenen te ontbinden gedurende zeven werkdagen, ingaande op de dag van het aangaan der overeenkomst.
- Om gebruik te maken van zijn herroepingsrecht, zal de consument zich richten naar de door de ondernemer bij het aanbod en/of uiterlijk bij de levering ter zake verstrekte redelijke en duidelijke instructies.
Artikel 7 - Kosten in geval van herroeping
- Indien de consument gebruik maakt van zijn herroepingsrecht, komen ten hoogste de kosten van terugzending voor zijn rekening.
- Indien de consument een bedrag betaald heeft, zal de ondernemer dit bedrag zo spoedig mogelijk, doch uiterlijk binnen 30 dagen na de terugzending of herroeping, terugbetalen.
- Indien de consument niet over een herroepingsrecht beschikt, kan dit door de ondernemer alleen worden uitgesloten indiende ondernemer dit duidelijk in het aanbod, althans tijdig voor het sluiten van de overeenkomst, heeft vermeld.
- Uitsluiting van het herroepingsrecht is slechts mogelijk voor producten:
b) die duidelijk persoonlijk van aard zijn;
c) die door hun aard niet kunnen worden teruggezonden;
d) die snel kunnen bederven of verouderen;
e) waarvan de prijs gebonden is aan schommelingen op de financiële markt waarop de ondernemer geen invloed heeft;
f) voor losse kranten en tijdschriften;
g) voor audio- en video-opnamen en computersoftware waarvan de consument de verzegeling heeft verbroken.
- Uitsluiting van het herroepingsrecht is slechts mogelijk voor diensten:
b) waarvan de levering met uitdrukkelijke instemming van de consument is begonnen voordat de bedenktijd is verstreken;
c) betreffende weddenschappen en loterijen.
Artikel 9 - De prijs
- Gedurende de in het aanbod vermelde geldigheidsduur worden de prijzen van de aangeboden producten en/of diensten niet verhoogd, behoudens prijswijzigingen als gevolg van veranderingen in BTW‑tarieven.
- In afwijking van het vorige lid kan de ondernemer producten of diensten waarvan de prijzen gebonden zijn aan schommelingen op de financiële markt en waar de ondernemer geen invloed op heeft, met variabele prijzen aanbieden. Deze gebondenheid aan schommelingen en het feit dat eventueel vermelde prijzen richtprijzen zijn, worden bij het aanbod vermeld.
- Prijsverhogingen binnen 3 maanden na de totstandkoming van de overeenkomst zijn alleen toegestaan indien zij het gevolg zijn van wettelijke regelingen of bepalingen.
- Prijsverhogingen vanaf 3 maanden na de totstandkoming van de overeenkomst zijn alleen toegestaan indien de ondernemer dit bedongen heeft en:
b) de consument de bevoegdheid heeft de overeenkomst op te zeggen tegen de dag waarop de prijsverhoging ingaat.
- De in het aanbod van producten of diensten genoemde prijzen zijn inclusief BTW.
- De ondernemer staat er voor in dat de producten en/of diensten voldoen aan de overeenkomst, de in het aanbod vermelde specificaties, aan de redelijke eisen van deugdelijkheid en/of bruikbaarheid en de op de datum van de totstandkoming van de overeenkomst bestaande wettelijke bepalingen en/of overheidsvoorschriften.
- Een door de ondernemer, fabrikant of importeur als garantie aangeboden regeling doet niets af aan de rechten en vorderingen die de consument ter zake van een tekortkoming in de nakoming van de verplichtingen van de ondernemer jegens de ondernemer kan doen gelden op grond van de wet en/of de overeenkomst op afstand.
- De ondernemer zal de grootst mogelijke zorgvuldigheid in acht nemen bij het in ontvangst nemen en bij de uitvoering van bestellingen van producten en bij de beoordeling van aanvragen tot verlening van diensten.
- Als plaats van levering geldt het adres dat de consument aan het bedrijf kenbaar heeft gemaakt.
- Met inachtneming van hetgeen hierover in artikel 4 van deze algemene voorwaarden is vermeld, zal het bedrijf geaccepteerde bestellingen met bekwame spoed doch uiterlijk binnen 30 dagen uitvoeren tenzij een langere leveringstermijn is afgesproken. Indien de bezorging vertraging ondervindt, of indien een bestelling niet dan wel slechts gedeeltelijk kan worden uitgevoerd, ontvangt de consument hiervan uiterlijk één maand nadat hij de bestelling geplaatst heeft bericht. De consument heeft in dat geval het recht om de overeenkomst zonder kosten te ontbinden en recht op eventuele schadevergoeding.
- In geval van ontbinding conform het vorige lid zal de ondernemer het bedrag dat de consument betaald heeft zo spoedig mogelijk, doch uiterlijk binnen 30 dagen na ontbinding, terugbetalen.
- Indien levering van een besteld product onmogelijk blijkt te zijn, zal de ondernemer zich inspannen om een vervangend artikel beschikbaar te stellen. Uiterlijk bij de bezorging zal op duidelijke en begrijpelijke wijze worden gemeld dat een vervangend artikel wordt geleverd. Bij vervangende artikelen kan het herroepingsrecht niet worden uitgesloten. De kosten van retourzending zijn voor rekening van de ondernemer.
- Het risico van beschadiging en/of vermissing van producten berust tot het moment van bezorging aan de consument bij de ondernemer, tenzij uitdrukkelijk anders is overeengekomen.
- De consument kan een overeenkomst die voor onbepaalde tijd is aangegaan te allen tijde opzeggen met inachtneming van daartoe overeengekomen opzeggingsregels en een opzegtermijn van ten hoogste één maand.
- Een overeenkomst die voor bepaalde tijd is aangegaan heeft een looptijd van maximaal twee jaar. Indien is overeengekomen dat bij stilzwijgen van de consument de overeenkomst op afstand zal worden verlengd, zal de overeenkomst worden voortgezet als een overeenkomst voor onbepaalde tijd en zal de opzegtermijn na voortzetting van de overeenkomst maximaal één maand bedragen.
- Voor zover niet later is overeengekomen dienen de door de consument verschuldigde bedragen te worden voldaan binnen veertien dagen na bezorging van het goed of in geval van een overeenkomst tot het verlenen van een dienst, binnen 14 dagen na afgifte van de deze overeenkomst betreffende bescheiden.
- Bij de verkoop van producten aan consumenten mag in algemene voorwaarden nimmer een vooruitbetaling van meer dan 50% worden bedongen. Wanneer vooruitbetaling is bedongen, kan de consument geen enkel recht doen gelden aangaande de uitvoering van de desbetreffende bestelling of dienst(en), alvorens de bedongen vooruitbetaling heeft plaatsgevonden.
- De consument heeft de plicht om onjuistheden in verstrekte of vermelde betaalgegevens onverwijld aan de ondernemer te melden.
- In geval van wanbetaling van de consument heeft de ondernemer behoudens wettelijke beperkingen, het recht om de vooraf aan de consument kenbaar gemaakte redelijke kosten in rekening te brengen.
Artikel 14 - Klachtenregeling
- De ondernemer beschikt over een voldoende bekend gemaakte klachtenprocedure en behandelt de klacht overeenkomstig deze klachtenprocedure.
- Klachten over de uitvoering van de overeenkomst moeten binnen bekwame tijd, volledig en duidelijk omschreven worden ingediend bij de ondernemer, nadat de consument de gebreken heeft geconstateerd.
- Bij de ondernemer ingediende klachten worden binnen een termijn van 14 dagen gerekend vanaf de datum van ontvangst beantwoord. Als een klacht een voorzienbaar langere verwerkingstijd vraagt, wordt door de ondernemer binnen de termijn van 14 dagen geantwoord met een bericht van ontvangst en een indicatie wanneer de consument een meer uitvoerig antwoord kan verwachten.
Artikel 15 - Aanvullende of afwijkende bepalingen
Aanvullende dan wel van deze algemene voorwaarden afwijkende bepalingen mogen niet ten nadele van de consument zijn en dienen schriftelijk te worden vastgelegd dan wel op zodanige wijze dat deze door de consument op een toegankelijke manier kunnen worden opgeslagen op een duurzame gegevensdrager.
